📜 TERMS AND CONDITIONS (BUBBLE SHOWS / EVENT PERFORMANCES)
- Scope
These Terms and Conditions apply to all contracts for artistic services provided in the form of bubble shows, animation acts, and event performances by the contractor.
Any deviating terms of the client shall not apply unless expressly agreed in writing.
- Contract Conclusion
A contract is concluded once a booking has been confirmed in writing (e.g. by email or written agreement).
Verbal agreements are only valid if confirmed in writing.
- Scope of Services
The scope of services is defined by the booking confirmation, the individual service agreement, and the technical rider (Indoor / Outdoor).
The technical rider forms an integral part of the contract.
- Technical and Organisational Requirements
The client is responsible for providing all necessary conditions for the performance in accordance with the technical rider.
This includes in particular:
- a flat, safe, and draft-free performance area (minimum 9 m², recommended 12 m² or more)
- no air currents in the performance area (no fans, air conditioning, or ventilation drafts)
- access to electricity (220V)
- access to running water
- safe storage space for equipment
- parking close to the venue
For outdoor events, the client must ensure either:
- a weather-protected alternative location, or
- the possibility to reschedule the performance in case of unsuitable weather conditions
- Fees and Payment
Fees are agreed individually.
Unless otherwise agreed:
- 50% deposit is due within 7 days after booking confirmation
- remaining balance is due within 14 days after the event
In case of late payment, the contractor reserves the right to withhold performance or withdraw from the contract without liability.
- Cancellation Policy
The following cancellation conditions apply:
- up to 14 days before the event: free cancellation, deposit refunded
- less than 14 days before the event: deposit is non-refundable
- less than 7 days before the event: up to 100% of the agreed fee may be charged as cancellation fee
In cases of force majeure, the parties may agree on a replacement date within 3 months.
- Force Majeure / Weather Conditions
For outdoor events, the risk of weather-related cancellation lies with the client.
A cancellation due to weather conditions does not automatically entitle the client to a refund of payments already made.
The parties will make reasonable efforts to agree on an alternative date.
Force majeure includes, but is not limited to: extreme weather, official orders, illness, technical failure, or other unforeseeable events beyond control.
- Liability
The contractor is liable only for damages caused by intentional misconduct or gross negligence.
Any liability for damages arising from:
- unsuitable venue or technical conditions
- lack of safety measures provided by the client
- misuse by third parties
- force majeure
is excluded.
The client is liable for any damage to equipment, costumes, or property of the contractor caused by the client, their guests, or third parties within their responsibility.
- Photo and Video Recordings
Photo and video recordings may be taken during performances.
The contractor is entitled to use such material for promotional and documentation purposes (website, social media, portfolio), unless otherwise agreed in writing.
The client is responsible for obtaining necessary consent from guests if identifiable persons are recorded.
- Music Rights (GEMA / SUISA etc)
The client is solely responsible for all necessary registrations, notifications, and payments to collecting societies such as GEMA (Germany), SUISA (Switzerland), or any other applicable rights organisation for the public use of music at the event.
This includes background music, live music, DJ sets, or any other musical accompaniment.
The client fully indemnifies the contractor against any claims, fees, or legal actions arising from the use of music at the event.
- Data Protection
The separate Privacy Policy applies in accordance with the GDPR.
- Copyright
All shows, concepts, artistic performances, and related content are protected by copyright.
Any reproduction, recording, or commercial use without prior written consent is strictly prohibited.
- Final Provisions
German law applies.
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.
Amendments must be made in writing.
The place of jurisdiction shall be the registered office of the contractor, where legally permissible.
